MEMBERS OF THE INDEPENDENT DISCIPLINARY CHAMBER
In accordance with the WADA World Anti-Doping Code, there is established within the structures of the Monegasque Anti-Doping Committee an independent Disciplinary Chamber responsible for investigating in first instance cases submitted to it by the President of the Committee. Monegasque Anti-Doping.
Depending on the case, it sits in collegial formation when it rules on disciplinary matters and as a single judge when it rules on precautionary measures.
In this context, its mission is to resolve disputes after hearing the parties and making all necessary findings.
This chamber is independent and is made up of three full members appointed for a period of three years:
– a member of a Monegasque judicial court, President of the Chamber, designated by the First President of the Court of Appeal;
– a phlebotomist doctor approved in the Principality, designated by the Director of Health Action;
– a lawyer, designated by the Director of Legal Affairs of the Prince’s Government;
and three alternate members appointed under the same conditions.
The members of the Disciplinary Chamber are appointed based on their ability to hear cases with fairness, impartiality and independence.
As such, the members will not have previously had any connection with the matter or any aspect of it.
In matters of precautionary measures, the single judge is a professional magistrate designated by the president of the Disciplinary Chamber.
The single judge having ruled on precautionary measures cannot, where applicable, be a member of the collegial panel called upon to rule on disciplinary matters on the same file.
The full member of the Disciplinary Chamber who assumes in his person a cause for challenge or considers in conscience that he must abstain, is replaced by his substitute or, where applicable, by one of the other substitutes, designated by the President of the Disciplinary Chamber. bedroom.
